What are the
Responsibilities of the Listing and Selling Realtors?
The listing Realtor has a legal duty to protect and to promote your best interest at all times. He or she owes you his or her undivided loyalty, and must disclose to you any and all information, obtained from any source, which might influence your decision. In addition, he or she may not reveal any information to another person which might jeopardize your bargaining position.
A selling Realtor can choose to represent you, the seller, in the same unconditional manner as your listing agent represents you, OR he/she can choose to represent the buyer. Because of this the selling agent should disclose to you his or her intentions regarding YOUR relationship and the nature of his/her relationship with the buyer. Remember that when the selling agent represents the buyer any information that you forward to him/her MUST be passed on to the buyer. Hence, if in doubt whom the selling agent is representing, ASK that agent for clarification on his/her position.
What are My Responsibilities as the Home Owner?Once you have hired a Realtor it is your duty to provide him or her with accurate information regarding your home. Generally, this includes your homes age, your current financing arrangements, the condition of the roof and hot water heater, your yearly property taxes and so on. In short, you must disclose both the good and the bad characteristics of your home. A Property Condition Disclosure Statement is sometimes utilized to solicit this information. Remember that the best policy to follow when consulting with your agent is HONESTY...this saves on future embarrassing situations and may be on future legal actions. Another important responsibility of you, the home owner, is to refer any and all inquiries about your property to your agent. It is his or her job to deal with these situations, it is what you have hired him/her to do, and it is what he/she has been trained for.
